About this step

In the State & Federal triggers section, you can:

  • Address any State or National Planning legislation matters and identify:

    • category determinations,

    • referral triggers, and

    • prescribed assessment matters.

We’ve made this process as simple as possible. Select from the list of mapping (location-based), activity, and other triggers in the left-side navigation panel. Then read the corresponding part of the State or National planning legislation in the centre navigation panel. You can then check the respective boxes that apply to the selected mapping, activity, or other triggers in the right-side navigation panel. Just roll down the list and work from left to right, top to bottom. Each time you complete an item/task in the list the task counter will update. When all of the tasks are complete the task counter will change to green and reflect the number of completed tasks equalling the number of tasks – e.g. “5/5”.

Our processing automatically pre-answers some rare triggers (noted as “Activities” & “Other” in the app) that may not be applicable to your application to save time. These tasks will appear green to show that they have been completed. You can go back and edit any completed section if required.

Should the development application trigger a referral, corresponding State assessment benchmarks in the reporting section are included automatically, as applicable.

Additionally, should the development application trigger prescribed assessment benchmarks other than a State assessment benchmark, you simply select the prescribed assessment matter from the list on the right-side side of the screen. A field will be automatically available for you to provide further information in the “Reporting” section under “Detailed assessment” and “State”. You can open the relevant part of the State or National Planning legislation in a new browser window. Simply select the “Open” button adjacent to the right of the legislation heading in the middle navigation panel of the screen. This is a really handy reference when completing detail about the prescribed assessment matter 

All overlay mapping triggers, any respective referrals, prescribed category of assessment, agencies, and corresponding prescribed assessment benchmarks are automatically formatted into the report.

How to assess your development proposal against the State planning instruments

  • Once you have reached the State & Federal step, you are required to complete a series of questions to help determine the State and National assessment against your development proposal.

Instructions

1. On the left side navigation panel under the heading State, go through each trigger listed under each subheading (Location, Activities and Other), if applicable.

Work left to right and top to bottom. 

As you go through and select each trigger on the left side navigation panel, the relevant section, part, division and sub-division of the applicable state planning legislation will be presented. 

2. Once at the trigger, read the relevant part of the state planning legislation in the middle navigation panel.

The app provides the planning legislation from the primary source, the state government website. This ensures that any updates to the planning legislation will be reflected within the step. 

3. Use the right navigation panel and check the applicable boxes, to determine the category of assessment and if preferable.

By selecting if the trigger is referable or not, the assessment benchmark will populate for completion in a later step (Reporting (Applicant)). 

If the trigger requires assessment against any other assessment benchmark, check the box 'Prescribed assessment matter' to add a section in the report to discuss it. A heading will populate in Reporting under Detailed assessment > State.

If a Location trigger (which is mapped) is found, you must respond to the questions in the right navigation panel. Activity and Other triggers (which are not mapped) may be applicable to the proposed development, but these will be taken to be irrelevant unless you select otherwise.'

4. Work your way through each referral trigger on the left, answering each question on the right. Once you have successfully completed the necessary parts within the step, select Save and Proceed to move to the next step, Codes (Applicant).

How to assess your development proposal against the Federal planning instruments

If your site is identified as being within the EPBC Protected Matters mapping, we recommend dealing with these matters prior to preparing the application.

2. Once at the trigger, read the relevant part of the federal planning legislation in the middle navigation panel.

The app provides the planning legislation from the primary source, the federal government website. This ensures that any updates to the planning legislation will be reflected within the step. 

3. It is at this point that we recommend having an exhaustive understanding of how federal matters may affect your application. Including any applicable planning material that will accompany the assessment.  

4. Work your way through each referral trigger on the left. Once you have successfully completed the necessary parts within the step, select Save and Proceed to move to the next step, Codes (Applicant).
